Introduction to Terms of Use Agreement:

This agreement becomes valid and effective as soon as you agree to it and start registering on the store according to Article 10 of the Saudi Electronic Transactions Law.

### **Article 1 - Introduction and Definitions:**

The introduction above is an integral part of this agreement. Below are the definitions and clarifications for the key terms used in this agreement:

2. **(Consumer):** The person who engages in e-commerce with the desire to obtain products or services provided by the store through its electronic platform.

3. **(Agreement):** Refers to the terms and conditions of this agreement, which govern and regulate the relationship between the parties of this agreement.

### **Article 2 - Consumer’s Legal Competence:**

1. The consumer acknowledges that they have legal competence under Sharia law and the applicable systems to engage with the store, or that their age is no less than eighteen years.

2. The consumer agrees that if they violate this clause, they will bear the consequences of this violation in front of others.

### **Article 3 - Nature of Commitment:**

1. The store’s commitment to consumers is to provide the **(service or product)**.

2. The store may provide other services such as after-sales services or other related services, depending on the nature and type of **(service or product)** requested by the consumer.

### **Article 4 - Usage Regulations:**

1. The consumer is obligated to use the store's electronic platform in accordance with public morals and the regulations in force in the Kingdom of Saudi Arabia.

2. The consumer must not use the service or product purchased from the store in a manner that violates public morals and the laws of the Kingdom of Saudi Arabia.

### **Article 5 - Account and Registration Obligations:**

Upon applying to join the store’s membership as a user, you are committed to providing certain information, choosing a username, and a confidential password for accessing the store’s services. By doing so, you agree to:

1. Be responsible for maintaining the confidentiality of your account information and password, and agree to immediately notify the store if any unauthorized use of your account information occurs or if your confidential information is compromised.

2. The store is not responsible under any circumstances for any direct or indirect, moral or material loss resulting from the disclosure of your username or login information.

3. You are committed to using your account or membership in the store personally, and you are fully responsible for it. If someone else uses it, this is deemed as granting them authorization to use the store on your behalf and for your account.

4. You are committed to using the store's platform with seriousness and credibility.

5. You must provide truthful, accurate, up-to-date, complete, and legal information about yourself as required during the registration process and commit to updating your information whenever there is a change.

6. Our store is committed to handling your personal information and contact details with complete confidentiality.

7. If the store finds that you have provided false, incorrect, outdated, incomplete, or illegal information, or violated any provision of the terms of use agreement, the store has the right to suspend, freeze, or cancel your membership or store account without prejudice to the store's other rights and legitimate means of recovering its rights and protecting other consumers.

8. In case of non-compliance with any of the above, the store management has the right to suspend or cancel your store or membership account, or block your access to the store's services.

### **Article 6 - Electronic Communication and Official Communication Channels:**

1. The parties to this agreement agree that communication will be made via the email address registered on the platform.

2. The consumer agrees that all agreements, advertisements, statements, and other communications provided electronically will serve as written documents and will stand as evidence in meeting the regulatory and legal needs.

3. The consumer agrees to be contacted and informed of any decisions related to this agreement or dealings with them through the store management sending general messages to all consumers or specific users of the store.

### **Article 7 - Modifications to the Terms of Use Agreement and Fees:**

1. If any clause or article in this agreement is canceled, or if any clause or article in this agreement becomes invalid, this will not affect the validity of the other clauses, articles, rules, and provisions in the agreement, and they will remain in effect until further notice from the store management.

2. This agreement, which may be modified from time to time according to circumstances, constitutes the work, understanding, and agreement between the **(consumer)** and **(store)**.

3. The store may charge fees to some consumers depending on the offers, products, or services they request, or what the state imposes in terms of fees or taxes related to the nature of the product or service.

4. The store reserves the right to add, increase, decrease, or discount any fees or expenses under the provisions and clauses of this Terms of Use Agreement, for any consumer, regardless of the reason for their registration.

### **Article 8 - Payment and Settlement Services for Stores:**

1. The store, through its partners, provides a payment and settlement system, which can be done entirely online via available payment options or through any other payment method the store provides from time to time.

2. The store commits to setting the price of the service or product displayed in its store according to the market value.

3. The store commits to providing invoices, receipts, and proof of delivery for all amounts and profits arising in its store and shall provide the consumer with a purchase invoice for services or products.

4. The store commits to providing the standard accounting specifications in its electronic store in compliance with the provisions of this agreement and the legal, economic, commercial, and regulatory benefits of this organization.

### **Article 9 - Intellectual Property:**

1. The intellectual property rights of the store are fully owned by the store, whether they were owned before the establishment of this electronic platform or after its establishment.

2. The consumer agrees to respect the store's intellectual property rights, including the store's name, words, logos, and other symbols related to the store or displayed on it. All rights associated with the store’s name are fully owned intellectual property rights of the store.

### **Article 10 - Store's Responsibility:**

1. The store is committed to conducting its business through this electronic platform in accordance with the applicable systems in the Kingdom of Saudi Arabia and according to the provisions of this agreement.

2. The store is not responsible for any claims resulting from errors or negligence, whether directly or indirectly, incidentally, or through the consumer or a third party such as shipping companies.

3. The store and its staff, owners, and representatives are committed to ensuring that the **(product or service)** is sound, legal, and authorized according to the laws and regulations of the Kingdom of Saudi Arabia and is used for legitimate purposes.

### **Article 11 - Restriction of Access or Membership:**

The store can suspend or cancel the consumer's membership or restrict their access to the platform's services at any time, without notice and for any reason, without limitation.

### **Article 12 - Applicable Law or System:**

This Terms of Use Agreement is governed by and formulated according to the laws, regulations, and legislation in force in the Kingdom of Saudi Arabia, and is fully subject to the applicable systems of the authorities in Saudi Arabia.

### **Article 13 - General Provisions:**

In case any clause or article in this Terms of Use Agreement is canceled or becomes invalid, this does not affect the validity of the remaining clauses, articles, rules, and provisions in the agreement, and they remain in effect until further notice from the store management.

This Terms of Use Agreement, which may be modified from time to time as needed, constitutes the usage agreement and working understanding between the store and the consumer. Both parties agree that the following should be taken into consideration:

1. The Arabic language is the language used when interpreting the provisions of this agreement, or when translated into another language.

2. All prices listed for the services or products in the store may be modified from time to time.

3. Promotional or marketing offers placed by the store are temporary, and the store reserves the right to modify or stop these promotional or marketing offers at any time.

4. Both parties to this agreement commit to interacting with each other in a manner that does not violate Sharia rules, regulations, and laws related to the nature of the interaction between the store and the consumer.

5. This Terms of Use Agreement can only be canceled through a decision issued by the store management.
